Acceptance of these terms
These Terms of Service (the "Terms") are a binding agreement between you and Koo. By creating an account, signing in, or using Koo in any way, you agree to these Terms, our Privacy Policy, and our Acceptable Use Policy, together with any other policies referenced in them. If you use Koo on behalf of an organization, you represent that you are authorized to bind that organization, and "you" includes that organization. If you do not agree, do not use Koo.
Changes to these terms and re-acceptance
We may update these Terms from time to time. When we make a material change, we will update the version and date shown at the top of this page and present the then-current version to you in the product. Your continued use of Koo after a new version takes effect, and — where we ask for it — your acceptance of the version shown in the product, constitute your agreement to the updated Terms. If you do not accept a new version, you must stop using Koo and may close your account.
Eligibility
You must be at least 13 years old to use Koo. If you are under the age of majority where you live, you may use Koo only with the involvement of a parent or guardian. Koo is not directed to children under 13; please see our COPPA Statement.
Your account and security
You are responsible for all activity under your account and for keeping your credentials secure. Koo uses Google-based sign-in and supports multi-factor authentication by text message, which we strongly recommend enabling. Tell us promptly at support@koo.io if you believe your account has been accessed without your authorization.
Service accounts and API tokens
You may create service accounts and API tokens that act on your behalf. Any action taken with a valid token is treated as taken by you and your account, and you are responsible for it. Keep tokens secret, scope them to only what they need, and revoke any token that is no longer needed or may have been exposed.
Your content
You retain all ownership of the code, data, and other content you deploy, store, or create on Koo ("Your Content"). You grant Koo only the limited license needed to operate the service — to host, store, process, transmit, back up, and display Your Content — for the purpose of running Koo for you. We do not claim ownership of Your Content.
Public showcase
Koo lets you publish an app listing to a public discovery surface. When you choose to publish, you grant Koo a non-exclusive, worldwide license to display that listing, its metadata, and its associated public URL to other users and to include it in discovery and showcase pages. You may unpublish a listing at any time; copies that were cached or already displayed may persist for a reasonable period.
Acceptable use
Your use of Koo is subject to our Acceptable Use Policy, which is incorporated into these Terms. You are responsible for Your Content and for ensuring that your use of Koo complies with all applicable laws and the rights of others.
Plans, fees, and billing
Koo offers Free, Plus, Pro, and Enterprise plans. Paid plans are billed as a subscription — a recurring plan fee plus any per-seat charges — through our payment processor, Stripe. Compute and related usage are metered and billed monthly in arrears: at the close of each billing period we total your usage, credit your plan’s included free allowance first, and charge only the remainder. Because the allowance can fully cover a period’s usage, a $0.00 invoice is a normal and complete invoice. You authorize us to charge your payment method for all fees when due. Fees are exclusive of taxes, for which you are responsible, and are non-refundable except where required by law or expressly stated.
Late payment and suspension
If a charge fails, we will attempt to notify you and to retry payment over a dunning period. If the balance remains outstanding after that period, we may suspend your account, which stops your running services and can make Your Content temporarily unavailable, until the balance is resolved. Prolonged non-payment may lead to termination and deletion consistent with our retention practices.
Availability and changes to the service
We work to keep Koo reliable, but we do not guarantee that it will be uninterrupted or error-free. We may add, change, or discontinue features, and we may set or adjust technical and usage limits. We will use reasonable efforts to give notice of materially adverse changes.
Export and portability
Your Content runs on open, standard runtimes from a Git repository or a container image, and Koo does not lock you in. You may export or move Your Content at any time. Self-service export and account deletion are on our roadmap; until they are available, contact support@koo.io and we will help you export your data or delete your account.
Termination
You may stop using Koo and close your account at any time by contacting support@koo.io. We may suspend or terminate your account or access if you materially breach these Terms or the Acceptable Use Policy, if required by law, or to protect Koo, its users, or third parties. On termination your right to use Koo ends, and provisions that by their nature should survive will survive.
Disclaimers
Koo is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that Koo will meet your requirements or operate without interruption or error. You are responsible for maintaining your own backups of Your Content.
Limitation of liability
To the maximum extent permitted by law, Koo and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of Koo. Our total liability for any claim relating to Koo will not exceed the greater of the amount you paid us for the service in the twelve months before the event giving rise to the claim, or $100.
Indemnification
You will defend, indemnify, and hold harmless Koo from and against any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of Your Content, your use of Koo, or your breach of these Terms or the Acceptable Use Policy.
Governing law and venue
